Terms of Service

By accessing or using EasySwing.trading ("EasySwing", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

EasySwing is operated by easyswing.trading, a sole proprietorship registered in the Netherlands ("we", "us", "our"). These Terms constitute a binding legal agreement between you and easyswing.trading.

EasySwing is a stock screening and market data visualisation tool designed for individual traders. The Service provides:

• A stock scanner that filters equities based on technical and fundamental criteria
• AI-assisted ranking of scan results based on publicly available market data
• Telegram alert delivery for breakout setups
• Integration with Alpaca Securities for order placement (using your own Alpaca account)
• A personal trade journal and watchlist

EasySwing is not a broker, investment advisor, financial institution, or regulated entity under any jurisdiction. The Service is provided for informational and educational purposes only. See our Risk Disclaimer.

• You must be at least 18 years of age to use EasySwing.
• You must have the legal capacity to enter into binding contracts in your jurisdiction.
• Access from jurisdictions where such services are prohibited is not permitted.
• You are responsible for ensuring your use complies with applicable local laws.

Account creation is handled through Clerk, our authentication provider. You agree to provide accurate information, keep your credentials confidential, and notify us immediately of any unauthorised access.

One account per person. You may not create accounts on behalf of others without express authorisation. We reserve the right to suspend or terminate accounts that violate these Terms.

You may use EasySwing solely for:

• Personal, non-commercial stock research and trade preparation
• Placing orders through your own connected Alpaca account
• Managing your personal watchlist and trade journal

You may not:

• Redistribute, resell, or sublicense any data or outputs from the Service
• Use automated scripts, bots, or scrapers to access the Service
• Reverse engineer, decompile, or attempt to extract the source code
• Share your account credentials with others
• Use the Service to engage in market manipulation, wash trading, or any illegal activity
• Attempt to circumvent rate limits, access controls, or security measures
• Represent EasySwing data as your own proprietary analysis for commercial purposes

Violation of these prohibitions may result in immediate account termination without refund.

EasySwing offers paid subscription plans. Billing is managed by Clerk Billing. By subscribing:

• You authorise recurring charges at the selected billing interval (monthly or annual)
• Subscriptions auto-renew unless cancelled before the next billing date
• Free trials, where offered, convert automatically to paid plans unless cancelled
• Prices are in USD and exclusive of any applicable local taxes
• Cancellations take effect at the end of the current billing period; no partial refunds are issued

We reserve the right to change pricing with 30 days' notice to existing subscribers.

EasySwing integrates with third-party services including Alpaca Securities (brokerage), Financial Modeling Prep (market data), and Telegram (alerts). Your use of these services is governed by their own terms and policies. We are not responsible for the availability, accuracy, or actions of third-party services.

Alpaca: Order execution is performed directly through your Alpaca account. EasySwing is not a party to any trade you place. All brokerage terms, margin rules, and regulatory obligations are between you and Alpaca Securities LLC.

All market data, prices, and financial information provided through EasySwing are sourced from third-party providers and may be delayed, incomplete, or contain errors. We make no warranty as to the accuracy, completeness, or timeliness of any market data.

EasySwing scan results, rankings, and alerts are generated by automated algorithms. They do not constitute investment advice or recommendations. See our full Risk Disclaimer.

All software, design, trademarks, and content on EasySwing (excluding third-party market data) are the intellectual property of easyswing.trading. You are granted a limited, non-exclusive, non-transferable licence to use the Service for the purposes described in Section 5.

No rights are granted to copy, modify, or create derivative works from EasySwing.

TO THE MAXIMUM EXTENT PERMITTED BY DUTCH AND APPLICABLE LAW:

• EasySwing is provided "as is" without warranties of any kind, express or implied
• We shall not be liable for any trading losses, missed opportunities, or financial damages resulting from use of the Service
• Our total liability to you for any claim arising from these Terms shall not exceed the total subscription fees you paid in the three months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Dutch law.

You agree to indemnify and hold harmless easyswing.trading and its operators from and against any claims, liabilities, damages, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.

We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service (or any feature) at any time. For paid subscribers, we will provide reasonable advance notice of significant service changes.

These Terms are governed by the laws of the Netherlands. Any dispute arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands.

Nothing herein prevents us from seeking injunctive relief in any competent jurisdiction to protect our intellectual property or confidential information.

We may update these Terms at any time. Material changes will be communicated to registered users by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
