Refund Policy

1. 14-Day Money-Back Guarantee
We offer a 14-day money-back guarantee on every paid charge for the Service, for any reason. You don't need to give us a reason to qualify. The guarantee covers:
- Your first monthly charge after a free trial converts to paid;
- Any subsequent monthly renewal — measured from the date of that specific charge;
- Annual prepayments — within 14 days of the annual charge.
The 14-day window runs from the date of the charge that is being refunded, not from the original signup date.
2. How to Request a Refund
Email support@easyswing.trading within 14 days of the charge, with:
- The email address on your account;
- The approximate date of the charge (or invoice number, if you have it).
You can also use the Cancel & refund button in your billing settings, which routes the same request automatically.
3. Timing and Method
- We aim to approve refunds within 2 business days of receiving the request.
- Refunds are issued through Clerk Billing to the original payment method (credit/debit card, etc.). We cannot refund to a different card or bank account.
- Card networks typically settle the refund to your statement within 5–10 business days, sometimes longer for non-EEA banks. The exact timing is controlled by your bank, not by us.
- When the refund is processed, your subscription is cancelled effective immediately and you lose access to paid features.
4. EU/UK Consumer Notice (Right of Withdrawal)
If you are a consumer in the EU or UK, you have a separate statutory 14-day right of withdrawal for digital services under Directive 2011/83/EU (and its UK equivalent), which begins from the date of contract conclusion.
At checkout, you expressly request that the Service start immediately and you acknowledge that by actively using the Service during the withdrawal period (e.g. running a scan, viewing live data, opening a Telegram alert) you lose the statutory right of withdrawal for any portion of the Service already performed, as permitted under Article 16(m) of the Directive.
Our 14-day money-back guarantee continues to apply regardless — it is a contractual commitment that runs in addition to any statutory rights you keep.
5. After the 14-Day Window
Outside the 14-day window we generally do not issue refunds, but we will always:
- Cancel your subscription on request, effective at the end of the current billing period;
- Stop all future charges immediately;
- Keep your data available for export for 90 days after cancellation, per the Privacy Policy.
We may, at our discretion, offer pro-rata refunds outside the 14-day window for unusual circumstances such as extended Service outages affecting your account.
6. What's Not Refundable
- Accounts terminated for cause under the Acceptable Use Policy (e.g. market manipulation, fraud, security attacks);
- Charges where a chargeback has already been initiated with the card issuer — once a chargeback is in flight, the issuer's process replaces ours;
- Repeat sign-up / refund cycles intended to abuse the guarantee. We may decline refunds for accounts showing this pattern;
- Third-party fees you incur outside the Service (broker commissions, exchange fees, etc.);
- Taxes that have already been remitted to a tax authority — where required by law, the tax portion may be refunded by the tax authority on a separate timetable.
7. Chargebacks
Before initiating a chargeback with your card issuer, please contact us first. Chargebacks cost both parties more than a normal refund, can take 60–90 days, and may flag your account in fraud-prevention databases. We will process any legitimate refund request directly and faster than the chargeback process.
Chargebacks initiated for charges you authorised and used, without first contacting us, are treated as a violation of the Acceptable Use Policy and may result in account termination.
8. United States Users — Subscription Disclosures
This refund policy applies to US users as a contractual commitment, regardless of any jurisdiction-specific statutory rights you may otherwise have.
California users — Automatic Renewal Law compliance. Under the California Automatic Renewal Law (Cal. Bus. & Prof. Code §17600 et seq., as amended by AB 2863 effective 1 July 2025), we confirm:
- Clear and conspicuous disclosure of the auto-renewal terms is presented at checkout and you affirmatively consent to them.
- Click-to-cancel. You can cancel through the same online mechanism you used to subscribe. The "Cancel" control is one click from your account page; cancellation takes effect immediately and stops all future charges.
- Annual reminders. For annual subscriptions, we send a renewal reminder 15–45 days before each renewal.
- Material-change notices. We provide clear and conspicuous notice of any material change to pricing or terms with at least 30 days' advance notice.
- Records of consent are retained for at least 3 years from the date of the consent or 1 year after contract termination, whichever is longer.
Federal subscription rules. The FTC's Negative Option ("Click-to-Cancel") Rule was vacated by the Eighth Circuit on 8 July 2025 (Custom Communications v. FTC) on procedural grounds. The FTC issued an Advance Notice of Proposed Rulemaking on 30 January 2026 to revisit the rule. We have voluntarily adopted the substantive practices the vacated rule required (click-to-cancel, clear and conspicuous disclosure, no misleading consent flow) to remain compliant with any successor federal rule and with state-level laws.
Disputes about refunds are resolved under Section 18.2 of the Terms of Service (binding individual arbitration with the AAA, with the class-action waiver and 30-day opt-out described there).
9. Changes to This Policy
We may update this Refund Policy from time to time. Material changes will be announced by email or in-app banner at least 14 days before they take effect. Refund eligibility is determined by the version of this Policy in effect on the date of your charge.
