# Refund Policy

## 1. 14-Day Money-Back Guarantee

Every paid charge for EasySwing.trading has a **14-day money-back guarantee**, for any reason. No questions asked. The window runs from the date of the charge being refunded, not from your original signup.

Applies to:
- First monthly charge after trial conversion
- Any subsequent monthly renewal (per-charge window)
- Annual prepayments (within 14 days of the annual charge)

## 2. How to Request

Email support@easyswing.trading with your account email and approximate charge date (or invoice number). Or use the "Cancel & refund" button in billing settings.

## 3. Timing and Method

Approval: within ~2 business days. Refund issued via Clerk Billing to the **original payment method**. Card networks typically settle in 5–10 business days; longer for non-EEA banks. Your subscription is cancelled immediately when the refund is processed.

## 4. EU/UK Consumer Notice (Right of Withdrawal)

EU/UK consumers have a 14-day statutory right of withdrawal under Directive 2011/83/EU. At checkout you expressly request immediate performance and acknowledge that **active use during the withdrawal period waives the statutory right** (Art. 16(m)). Our 14-day money-back guarantee continues to apply as a separate contractual commitment.

## 5. After the 14-Day Window

We generally don't refund outside 14 days, but we always cancel on request, stop future charges immediately, and keep your data exportable for 90 days. Discretionary pro-rata refunds may be offered for unusual circumstances like extended outages.

## 6. Not Refundable

- Accounts terminated for cause under the Acceptable Use Policy
- Charges where a chargeback is already in flight
- Repeat sign-up / refund-cycle abuse
- Third-party fees (broker commissions, exchange fees)
- Taxes already remitted to a tax authority

## 7. Chargebacks

Please contact us before initiating a chargeback. We process legitimate refunds directly and faster than card-network dispute processes. Unauthorised chargebacks may be treated as AUP violations.

## 8. United States Users — Subscription Disclosures

This refund policy applies as a contractual commitment regardless of jurisdiction.

California ARL (Cal. Bus. & Prof. Code §17600 et seq., as amended by AB 2863 effective 1 July 2025): clear and conspicuous auto-renewal disclosure at checkout with affirmative consent, click-to-cancel via the same online mechanism used to subscribe, annual reminders for annual subscriptions 15–45 days before each renewal, material-change notices with at least 30 days' advance notice, consent records retained 3+ years.

Federal: the FTC Negative Option / "Click-to-Cancel" Rule was vacated by the 8th Circuit on 8 July 2025 (Custom Communications v. FTC) on procedural grounds. The FTC issued an ANPRM on 30 January 2026. We voluntarily follow the substantive practices the vacated rule required.

Disputes resolved under Terms Section 18.2 (AAA arbitration, class-action waiver, 30-day opt-out).
