# AI Usage Policy

## 1. What Soren Is

Soren is the conversational AI assistant inside EasySwing.trading. Powered by large language models from third-party providers (Anthropic and/or OpenAI, accessed directly or via OpenRouter). Soren can answer questions, run internal tools (scans, lookups), and format outputs. Soren has no memory of other users' accounts.

## 2. What Soren Is Not

Soren is not a financial adviser, broker, fiduciary, or regulated entity. Soren does not provide personal investment advice within the meaning of MiFID II, the Investment Advisers Act, FINRA, or FCA COBS 9. Soren does not place orders or manage money.

## 3. AI Outputs Can Be Wrong

LLMs can produce confident but wrong, outdated, biased, or fabricated outputs — including fake prices, made-up news, invented tickers. Verify before acting on any factual claim.

## 4. Data Flow

Your message + recent conversation + system prompt is sent to the AI model provider's API. The provider returns a response, which is shown to you and stored in your chat history. Tool calls (market data, screener) run on our infrastructure, not the AI provider's. We do not send your email, name, payment data, or full broker activity to AI providers.

## 5. Training Use, Retention, and Provider Commitments

- **No training on your data.** Provider terms we use prohibit using your inputs and outputs to train their general-purpose models. Where zero-data-retention is offered, we prefer it; otherwise providers' default short-term API logging (typically up to 30 days) applies.
- **Our retention.** Chat history stored for 90 days rolling. You can delete individual conversations or full history any time. Backups roll off within 30 days.
- **No model fine-tuning on customer data.** If that ever changes, we will announce it in advance and require affirmative opt-in, with opt-out available.

## 6. Automated Decision-Making (GDPR Art. 22)

Soren does not make decisions producing legal or similarly significant effects. See Privacy Policy Section 9.

## 7. EU AI Act Positioning

The EU AI Act (Regulation (EU) 2024/1689) phases in: Art. 5 prohibitions from 2 Feb 2025 (Service uses none); GPAI obligations from 2 Aug 2025 (bind upstream foundation-model providers, not Sofus); Article 50 transparency obligations from 2 Aug 2026 (we have implemented these notices voluntarily in advance); full applicability 2 Aug 2027.

Soren is a general-purpose AI assistant in a non-high-risk informational context — not used for credit scoring, employment, biometric ID, or other Annex III high-risk uses. We are tracking the EU AI Office's Code of Practice on transparent AI systems (workshops concluding May 2026) and intend to align with its measures once published, giving us a presumption of conformity with Article 50 under Article 56.

## 8. Your Choices

- Turn off AI features in settings — screener, watchlists, journal, alerts continue to work.
- Delete chat history any time.
- Export chat history via Privacy export tool or by emailing privacy@easyswing.trading.
- Exercise full GDPR rights as described in the Privacy Policy.

## 9. Your Responsibilities

Treat AI outputs as starting points, not instructions. Verify independently. Don't represent AI outputs as your own professional analysis for compensation. Don't try to jailbreak or extract our prompts. Don't submit material non-public information (MNPI) to Soren — it is not a confidential channel.
